			<content:encoded><![CDATA[<p>?  I know it isn't....but is there anything I can print out, like a claus from the Fair Credit Reporting Act that states it is within their rights to delete it, and NOT a violation?  This is what there response was, word for word:</p>
<p>&quot;Dear Mr. X,<br />
I am returning you letter and offer for settlement unsigned.  I am unable to sign this agreement as the part where I agree to delete this account from your credit file would be in violation of the Fair Credit Reporting Act.  If you wish to send $XX, we will mark your account paid in full and report it as such to the credit reporting agencies.&quot;</p>
<p>I don't want to be pushy with them, but I would like to show them proof that it is okay for them to make the agreement, and see what they say from there.  The amount I owe is .  The only reason I want a pay-to-delete is because the account is 6 years old.  I am not dingy enough to pay it and just have it re-aged.  I'd rather wait another year after it is off of my credit report and pay it then, if they refuse to accept the agreement.<br />
Well, it is actually on my fiancee's credit, and it is a medical bill.  The original debtor is not on any of his credit reports at all (so they have nothing to delete), only the collection agency.  I understand the re-aging process, which is why we don't plan on paying it unless they agree to delete it.  He wants to get financed for a vehicle and that is the only reason we are trying to get it removed early.  He has never checked his own credit before, which is how 56 bucks has haunted him this long <img src='http://credit-cards-for-fair-credit.com/wp-includes/images/smilies/icon_razz.gif' alt=':P' class='wp-smiley' />   All I really want to know is if there is something in the Fair Credit Reporting Act that states it is OK for them to delete it if they want to.</p>

			<content:encoded><![CDATA[<p>Is it proper under the Fair Credit Reporting Act for hospitals to give debt to a collection agency after just 60 days and for the Collection Agency to report it as a collection action to the credit reporting agencies? It appears as an adverse action even if all payments were made on schedule. It doesn't matter how much the bill was one of our local hospitals does this. Talking to the hospital does no good they say this is just their method of setting up payments.<br />
You guys are getting part of the problem. This hospital wants payment in full within 60 days if not they refer it to collection making payments or not. The bothersome part is that the collection agency reports it as a collection action no matter what if they get it this seems unfair since it appears on credit reports every time.<br />
Additional info, this hospital used to refer you to a finance and loan if you went over 60 days paying a bill. I have checked my credit report and they report every payment on time yet it appears on Transunion , Experian, and Equifax as an &quot;adverse account action&quot;. To me this is an immoral if not illegal action. What I need to know is if this is allowed by the  Fair Credit Reporting Act of 1978 Sec15 -1681 US code. I know of no other way to fight it. Does anyone understand its pages and pages of complex jargon enough to tell me?<br />
This hospital Has no collection department and does no collection of their own. They use the collection agency for their accounts payable.<br />

Why is getting out of my contract so hard?</p>
<p>I am currently a dish customer.</p>
<p>I REALLY want out of my contract, but they keep threatening me with a fee for disconnecting.<br />
I understand that there was a penalty for leaving early, but I didn't think I was doing that, until the CSR I talked to told me that I had aggreed to another two year contract by acceptin an HD reciever that didn't work to begin with, and is STILL in the process of bieng fixed (by me, of course - the sent some kit for me to deal with).</p>
<p>It sucks that they were so dishonest about the contract renewal issue. I WANT OUT!</p>
<p>I was offered a WAY better deal somewhere else, and I have a question:</p>
<p>I was told my a freind the there is something under the &quot;fair credit reporting act&quot; that states I only have to pay 10$ a month to the Dish people and it won't affect my credit if I disconnect.</p>
<p>Even if I pay the penalty (which has changed three times since I called) - I will still save $ over the dish.</p>
<p>I want OUT! but I don't wanna screw up my credit!<br />
So my question is simple:<br />
Do I only have to pay ten $ a month to avoid problems?<br />
And:<br />
How do you get a straight answer about what they want to charge you? Is there a website or something?<br />
Something in writing?</p>
<p>PLEASE HELP ME!!!!!!!!</p>
<p>Every time I call I am put on hold, and told a different story when I get a rep. Any Ideas?</p>

But I always hear about troops who are late on payments being told by loan companies that they will call their chain of command and tell them they are missing payments.  I already know indebtedness is covered under UCMJ and for a security clearance your credit is checked.  But is there a clause in the FCRA that allows companies to call your chain of command if you're late?  From what I know if they called a civilian employer the person in debt could actually sue.

he loan was charged off - then sold to a collector.<br />
Last summer, that company contacted me to try to get me to pay up (20k).  I obtained a laywer to determine if my rights were being violated.<br />
After 6-7 letters from my attorney to this company, they never responded with any type of documentation.  They were given at least 45 days.<br />
What do I do now?  Now another company has bought it.

They said it's years old and she needed to pay them immediatly over the phone.  She of course said no and told them under her rights of the Fair Credit Reporting Act she disputed it and wanted a copy of the original bill and details of what it was for; who it was, etc so she could make sure she hadn't paid it in the past.  They sent her a single peice of paper with their company name on it and the amount, that's it!  Is that legal and I need the exact writing in the Fair Credit Reporting Act that says they have to send proof of the bill within 30 days if requested.  Thanks!!!

			<content:encoded><![CDATA[<p>Ok, here is my question. A few months back, I paid an attorney money that was owed to a company on my credit report. I have paid in full, and they have yet to send me my receipt stating that it has been paid in full. I called them up over a month ago, and the lady on the phone said that she would send it out that day, still nothing. I'm going to call them again today, but are they in violation of the fair credit reporting act? </p>
<p>They have very poor business practices too. I paid them in 2 separate installments  the first was 0, and the second was 0. The first payment, I authorized, but the second payment, they were suppose to send me something in the mail before they took, but I never received anything. Just a bank account that was overdrawn by almost 0. They claimed that they sent that letter out to me, but I never received anything from them, once again. After that charge was made, that's when I wanted my receipt. They told me that they would send out the receipt after I signed the credit card authorization for (which by the way, had no problem finding my mail box). After I received it, I signed it, and sent it back. After a few weeks, that's when I called them to find out where the receipt was, and that they were gonna send it out to me that day. </p>
<p>If they are in violation of the credit act, who do I contact about this? What part of the act are they in violation of?

I'm 22 years old and I don't work (i'm an online student) and I live with my parents. 3 days ago I tried to open a basic bank account online(MyAccess Checking and Regular Saving), and they ask for minimum  for each and I paid them by my father's Credit Card. They said you'll receive an e-mail withen 1-2 business days. I received an e-mail today saying that &quot;We are unable to open your account(s) at this time. Our decision was based in whole or in part on information obtained in a report from a consumer-reporting agency. Under the Fair Credit Reporting Act, you have the right to access the information contained in your credit file at the consumer-reporting agency.&quot; </p>
<p>Why is that? I don't have anything wrong because that's my first time to open a bank account and it's my first time to use my name.</p>

Apparently, if you file a dispute letter, and the credit card company responds in the 30 days outlined in the Fair Credit Reporting Act, you can file another letter next month, and just keep doing this until they get tired of dealing with you and let it be taken off of your credit report. I just want to know if this is true or not.
