It seems like divorce proceedings and Chapter 13 bankruptcy would go well together since they both can cause financial hardships for both people involved. Since you already have a lawyer, shouldn't you try to use him for that too? Plenty of people who are in debt end up getting divorced and don't know what to do about it. Instead of having to worry about them immediately, with Chapter 13 bankruptcy, you can worry about your debts in two to five years. Financial decisions that are part of the divorce will also be affected when going to bankruptcy court. So, should you really file for bankruptcy while in the middle of a divorce?

The first negative involved with filing bankruptcy during the time when your divorce is still in process is the fact that the courts will issue an automatic stay order. In addition to your divorce action, this order will put on hold all lawsuits from your debtors. Your divorce won't be able to proceed until another order is issued saying it's ok. Also, the court will have the power to review all agreements you make in divorce court.

Although some people think that they can't file for Chapter 13 bankruptcy during a divorce, there's nothing to stop them. However, keep in mind that this may not be the best time to do so since you'll have plenty of other things on your mind. Besides, you won't be able to complete the divorce until your bankruptcy case has been resolved.

After you have had your divorced finalized, the payment plan that was established by bankruptcy court will remain in effect. The divorce settlement has to address who will make the payments. This is just something else for you and your soon-to-be-ex to argue about potentially.

Although you can legally file for Chapter 13 bankruptcy at the same time you are filing for divorce, it will add complications to your life that you may not want to face at the same time. That's it. She didn't give a reason of why they are bad. Well my dad told me to get a credit card and car in my name (parents were going through a divorce and dad said he needed a car that mom can't touch thus the reason why it went in my name) and I listened to him and believed the things he said about paying them off and how he knew what he was doing. He didn't pay and my credit got ruined.

    Well I paid off the debt I was in and I know I have poor credit (in the low 500's). Now my boyfriend and I have an apartment that's in my name, the utilities are in my name, I have a cell phone plan in my name, and I have a 0 credit card in my name. My boyfriend has great credit because his parents taught him all the things he needed to know and they are teaching me. They said having the those things in my name and paying them off when they are due will help my credit.

    I pay off the credit card every time I use it and I never go over the limit. My boyfriend and I pay off the rent on the day it's due and we send in the payment for the utilities the moment we get the bill. And I also pay off my cell phone bill the moment I get my bill.

    How much will having the apartment, utilities, cell phone plan, and credit card in my name boost my credit? Will I have fair credit by next year or will it take a longer time? What are some other ways I can help boost my credit with?
    Sorry, I worded how I pay off my credit card wrong. The minimum payment is and I'll use between 0 - 0 and I'll pay - 100 a month. And after I use the 0 - 0 I put my credit card away and won't use it til I pay off what I used.

      With the economy down and it impossible to get credit. Do you think it is a good idea to lower the credit standards so that it is easier to get credit. For example. Those that currently have high credit scores should be able to pay no interest on any loans. And those that have fair credit scores should enjoy the low interest rates of the people that had excellent credit. And for those that have poor credit, they should have decent rates, not sky high rates. In other words if they get rid of high interest on loans, do you think the economy will improve?

      I had a bankruptcy discharged 12/05, and am still struggling to increase my credit score in order to buy a house (not very soon, I suspect). What would be the minimum score I would need?
      Also, I am about to start a divorce, and I wonder how long after that is final before I can realistically get a mortgage?

      I have good job security after 5 1/2 years, and decent income. I do have plenty of student loans though.

      Me and my fiance are getting married on May 10 and we want to purchase a home.
