<p>2 of them I'll need to stop paying for now, but I'm not going bankrupt yet.</p>
<p>Can I keep the third credit card if I keep paying it? </p>
<p>Or will the 2 other credit card companies call them and tell them to cancel me also?</p>
<p>I would like to add that I will NOT ask for aditional credit from the existing card in positive balance. </p>
<p>So they will not contact the credit bureau.

			<content:encoded><![CDATA[<p>I have been searching for solid evidence of what the statute of limitations is on collecting a debt for a credit card. I have found everything from 4 years to 15 years but nothing with any actual legal codes stateing the time limit. Can any of you direct me to a website that will provide concrete laws on this. I have tried the fair credit bureau, I've tried googling it, I've tried Ohio Law Library and still can't decipher the law on this. Some state that a credit card is considered a written contract therefore it is a 15 year limit. Others state that it is a revolving account, making it 4-6 years. Any help would be greatly appreciated.

This letter is being sent to you in response to a viewing of my credit report and observance of your agency listed as one of my past accounts. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.<br />
This is NOT a request for â€œverificationâ€ or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.<br />
Please provide me with the following:<br />
â€¢  What the money you say I owe is for;<br />
â€¢  Explain and show me how you calculated what you say I owe<br />
â€¢  Provide me with copies of any papers that show I agreed to pay what you say I owe;<br />
â€¢  Identify the original creditor;<br />
â€¢  Prove the Statute of Limitations has not expired on this account<br />
â€¢  Show me that you are licensed to collect in my state<br />

At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureauâ€™s (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:<br />

If your offices are able to provide the proper documentation as requested in the following Declaration, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist.<br />
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.<br />
If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.<br />
I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS.<br />
It would be advisable that you assure that your records are in order before I am forced to take legal action. This is an attempt to correct your records, any information obtained shall be used for that purpose.<br />

<p>Most places online that i've found says to send a debt validation (DV) letter to the CA (collection agency) and then if the CA can't verify the debt to send another DV to the CRA (Collection Reporting Agency or credit Bureau) after 30 days if no response, then send a follow up letter quoting the Fair Debt Collections ACT (FDCA) articles and what not saying they have violated the FDCA and need to delete said credit items. I've looked up numerous examples of these letters and most seem to operate under the impression that said debt is unknown to debtee or that I would be unaware of the debt. The Problem is, I know it exists and have even paid it off, but do i operate as if i dont know and see if the CA can validate a debt that has been paid off? And if they cant then go after the CRA? What could be the possible reprecussions of doing such a thing? Or should I just send a DV to the CRA right off the bat seeing if they can validate said debt and then go from there. What steps should I take? Or should I deal with the fact that this debt will stick with me for 7 years.

<p>I remembered setting up a monthly scheduled payment to automatically take the money out of my checking account to pay on my credit card so I wouldn't have to worry about it. Foolishly, after setting up this payment, I didn't bother to check my balance as I trusted it was taken care of. WRONG. </p>
<p>I check my credit report every month, and got a notice that a negative item had been posted. The aforementioned credit card was apparently past due, saying I had not made a payment since August. This floored me. Like I said, I thought those payments were being made. Anyhow, the negative item dropped my score by 75 points. Luckily it was Excellent, so now it's just down to Fair instead of poor, but it still smarts. I made the payment that was due and then some, so now I am current. It was never about not being able to pay. I must have incorrectly gone through the procedure to set up my bill payment, and the money just never got drafted. Ironically, I haven't used that card in months.</p>
<p>My question is this: Now that I'm current (and I actually intend to pay off the rest of the balance with my bonus check from work next week), can I expect to see any increase in my score at the next reporting period? I understand the report of my delinquent account will stay on my record for a few years. What I'm wondering is if my score can possibly recover.</p>
<p>And in case any of you are wondering, yes, this has taught me a valuable lesson about checking on my accounts to make sure those payments are being made!<br />
I've already contacted the credit card company. The fact that, in my five year of being a customer, this is the first time I've had a delinquent report does not matter to them. They also will not modify thir report to the credit bureau because the &quot;mistake was not on [their] part.&quot; Therefore, the information will stand.

<p>Here is a recent history;<br />
12 Dec '09 credit score was 654,602,580,<br />
22 Dec '09 signed up with True Credit for 3 bureau monitoring<br />
22 Dec also signed up with a Credit Repair Co. who has an A+ rating with the  BBB<br />
23 Dec Credit Repair co placed round of disputes<br />
26 Dec I paid off maxed credit card from 50 - 1<br />
18 Jan credit scores - 798,751,734<br />
8 Feb Mortgage Lender pulls scores and says they are 644,630,634 on a report they produce.<br />
How can this be??<br />
18 Feb True Credit says my score is still roughly the same 792,745,734 (dropped a few points after lender pulled report)<br />
My mother-in-law is applying with me on the loan. The lender pulled her credit too and says mid to low 600's - Trans Union says mid to upper 700's! (She has no delinquencies + not working with a credit repair company). Both company's use Fair Issac.<br />
What in the world is going on? Please help we really need to buy a home. Thank you for your help.

<p>I'm aware of the free credit report everybody is entilted every year but I hear many people saying that you could get a free credit score as well. It appears that the scores are not free and in order to get my FICO score I would have to pay 15.95 from each credit bureau, is this true?<br />
I have another question. Is about the Fico website there is something about a free 30 Day Trail and if you don't cancel you will be charged for the  annual subcription of 89.95. Anyone use this before? I read it but I'm not sure exactly how it works.
